Default and Termination
GUEST DEFAULT :
The following act(s) constitute a default of this Agreement by Guest(s) (“Guest Default”) :
ACCELERATION :
If a Guest is in Guest Default, Management may accelerate the Rate and all other charges and fees which are payable during the remainder of the Term without notice or demand.
MANAGEMENT’S RIGHT TO TERMINATE AGREEMENT :
Management may terminate this Agreement for any reason (including Guest Default) or no reason and require Guest to vacate the Property by providing Guest written notice (a “Termination Notice”). Guest agrees to render peaceful possession of the Licensed Unit to Management within three (3) days of the date provided on the Termination Notice. Three (3) days’ notice shall not be required if such termination is the result of a Guest Default (as defined herein), in which case the Termination Notice may be effective immediately. Upon Guest’s peaceful surrender of the Licensed Unit to Management, Management will refund to Guest the proportionate amount of any unused amounts previously paid by Guest to Management if Guest is not in Guest Default. If a Guest is in Guest Default and does not remove their belongings from the Licensed Unit when they vacate the Property, such belongings will be removed by Management and either disposed of in the garbage and or donated to a charitable organization in accordance with applicable laws.
GUEST TERMINATION:
AFTER THE INITIAL TERM, GUEST IS REQUIRED TO PROVIDE MANAGEMENT A MINIMUM OF SEVEN DAYS WRITTEN TERMINATION NOTICE.
Guest understands that this Agreement will remain in effect and Guest will be liable to pay as set forth in this Agreement whether or not the Guest occupies the Licensed Unit and Property for the agreed Term.
EARLY TERMINATION BY GUEST :
Management may recover as damages for Guest early termination of this Agreement an amount equal to the amount that remains outstanding for the remainder of the applicable Term of this Agreement, including appropriate federal, state, city and municipal taxes owed as a result of early termination, and including forfeiture of any applicable deposit(s).
